Greetings Videotron! I'm emailing you because one of your customers, a Mr. Patrick Clouet from Beauport, PQ, has used his Videotron Internet account to defraud me of $1340.00 Canadian. I've attached the latest emails in both Outlook and plain text format, but I'll summarize the order of events for your convenience: July 22, 2001 - I win the Bargain and Haggle.com bid for the Olympus E-10 Camera July 23, 2001 - Patrick tells me he will ship the camera as soon as I give him a tracking number for the money order July 24, 2001 - I ship him the money order (scan attached) and the tracking number July 27, 2001 - Patrick gives me a false tracking number for the camera shipment July 31, 2001 - Patrick admits his girlfriend received my payment, and I'll have my camera tomorrow August 1st, 2001 - Patrick admits the camera was never shipped at all August 5th, 2001- Patrick offers me a refund August 15th, 2001 - Still no refund from Patrick, he faxes me a shipping invoice indicating he's sent my money, but the address is incorrect on it September 4th, 2001 - Still no refund from Patrick September 18th, 2001 - Patrick claims he sent my refund on the 14th September 22nd, 2001 - Still no refund from Patrick September 24th, 2001 - Patrick emails me and says all he can do is pay me in two instalments, proving that all previous emails saying he sent me a refund were lies. I don't believe this offer to pay me is any more realistic than his previous lies. I've waited nearly two months for Patrick to make good on his promises and refund my money, but he hasn't done so. I was looking through your service agreement, and I believe Patrick is in violation of this clause: "4.3 - Compliance with Laws and Netiquette. The customer shall not use or allow the use of the Services in a manner or for a purpose which is abusive or contrary to any law or regulation in force. The customer agrees to abide by the rules of Netiquette, which rules are included in this Agreement, mutatis mutandis." I obviously am not holding Videotron responsible for Mr. Clouet's criminal behaviour, but he's using your service to commit fraudulent acts, so you're either part of the problem or part of the solution. In addition to emailing you, I'm: • Contacting Bargain and Haggle.com and filing a complaint against Mr. Patrick Clouet • Contacting my local police department in Calgary, Alberta to find out how to file fraud charges against Mr. Patrick Clouet • Asking my lawyer to commence a private lawsuit agsinst Mr. Patrick Clouet for defrauding me and the immense amount of time I've spent on trying to regain my funds I therefore request that you immediately suspend Mr. Clouet's Internet account so he cannot defraud others.
