DIGITAL CAMERA FRAUD

The purpose of this site is to detail the history and methods 
used by Patrick Clouet (a.k.a. "Real Life") to defraud me of $1340 Canadian.

On July 24th, I sent Patrick Clouet a money order for $1340 CND. As of September 24th, I have neither the E-10 digital camera or my money back. Patrick lives in Quebec, Canada, while I live in Alberta, Canada. I chose to buy the camera off of him because I thought I'd save money not having to pay a customs tax for it to come across the border. Little did I know this would turn into a 2 month battle to get my money back. At first I thought he was simply an amateur when it came to selling things online and was very patient with him. He had two successful auctions on Bargain and Haggle.com, so I thought he was a reputable person to deal with. I was wrong, thus began this tale.

JAN 29, 2003 UPDATE: I had basically given up hope of getting any of my money back, since my last update, I've received two cheques from the collections agency! The first was for $267.17 CND, and this current one is for $284.98. Of the original $840 owed, Oligny & Thibodeau will take $210 as their cut, but I'll get $630 back. I talked with them today since all the paperwork they sent me was in French (which I can't read), and it seems Patrick has given then the final cheque, so once it clears on their end, I'll receive the final payment. Amazing! I should have gone the collections agency route first - if you happen to get ripped off by Patrick or anyone else in the province of Quebec, I strongly recommend you contact Oligny & Thibodeau at 1-450-348-1519.

SEPT 17, 2002 UPDATE:
Believe it or not, I still haven't given up on getting my money back. I've heard from a fellow in Quebec who actually worked with Patrick Clouet at one point. He says that Patrick was fired for defrauding the company of $20,000. If Patrick is capable of that level of fraud, I'm not sure I'll ever see my money, but I received a tip from someone on a collections agency in Quebec. They are called Oligny & Thibodeau, and while their cut of 25% is a little steep, I only pay if they are successful. I figured I have nothing to lose, so now Patrick has a collections agency on his case - I truly hope they make life difficult for him.

5, 2002 UPDATE:
I'm getting a lot of email about this site from visitors, so I thought I'd answer a few of the questions I keep getting:

"Why don't you go see Patrick in Quebec and get your money back?"

Quebec is on the other side of Canada, roughly 2000 miles away from me - I'd spend more on a plane ticket than he owes me.

"Why don't you contact Canada Post - isn't it mail fraud?"
I tried that, but Canada post says it's not mail fraud - and I could find no one at the post office able to even give me a description of what would QUALIFY as mail fraud.

"Why don't you contact the police - isn't it criminal fraud?"
I contacted the police in my city, but unless it's fraud on a much larger scale, they don't get involved. I tracked down the criminal investigations unit in Beauport, Quebec where Patrick lives. I found a kind officer who agreed to call Patrick even though it's not a criminal matter in their eyes. Patrick told the officer that he was simply re-selling equipment, trying to make a few bucks, and that he's send me payment. That was in early January, two months ago. So it seems that Patrick has no problem lying to the police either. The one time I've needed help from the police in my life, and they won't get involved. <sigh>

"Why don't you sue him?"
That's my next step.

A friend of mine sent me an URL to a very interesting article published by the Toronto Start about a guy people charges with 17 counts of fraud related to digital cameras. I wonder if he's a friend of Patrick's? :-)

There's been an interesting twist in this saga. I received an email from R.E. Young, a fellow from the North Carolina (USA), who was ripped off by Patrick in exactly the same fashion! Digital camera fraud with exactly the same excuses - invalid tracking numbers, false claims, etc. The amount? Roughly $1200 CND! R.E. Young found this web site through a search engine, which is something Patrick Clouet fails to understand: as long as this site is up, it's doubtful he'll ever get a job anywhere if they do a web search for his name (a very common thing with jobs now). If you type the term "digital camera fraud" or "Patrick Clouet" into Google.com, this site is listed as #1. Everyone will know what he does to people! I've also discovered that Patrick is using a new email address to defraud people: [email protected]. I've emailed the people who run the site and hopefully they'll deactivate his account. R.E. Young sent me the email correspondence he had with Patrick, so I've created a web page with all the details, including a copy of the FedEx bill showing the money order being sent to Patrick Clouet.

Has Patrick defrauded you of money? Please email me and let me know! I also have Patrick's cell phone number now, so I called him to talk with him. He refuses to speak English, but I know it's him - he hung up on me when I said who I was.
R.E. Young has also filed a complaint with the FBI Fraud Complaint Center, so perhaps that will alert Patrick to the fact that he can't go around ripping people off...

28, 2001 UPDATE

I should have known better...it's been over one month since the last entry in this saga, and I haven't seen any more money from Patrick. I didn't mention this earlier, but according to the police, this isn't a "criminal matter" - I have to pursue this in the civil courts. It's also not mail fraud according to the person I spoke with at the post office. I just love the fact that my tax dollars are so hard at work for me - no one wants to help. My next step is to get a lawyer involved, and even if it ends up costing me more than $840 CND, I'm determined not to let Patrick get away with this. Patrick has also changed his email address, so my only point of contact is to phone or mail him.

21, 2001 UPDATE: Good news! Patrick sent me a money order for $500 CND, and it cleared without any problems! :-) I'm very happy to have received a portion of my money back, and Patrick says I should the other $840 within one week. We'll see if that happens, but it's certainly a step in the right direction.

OCT 29, 2001 UPDATE

True to form in this sad little tale, the second cheque has also bounced (see thumbnail images below).  At least the reason was expected this time - Patrick closed his bank account because I posted his cheque on this web site (the bank account number has now been censored). At any rate, Patrick is still making promises about paying me and so far nothing has happened. You can read more in the chronology of email exchanges between us, but if I don't have payment by this Friday I'm going to get the police and Canada post involved (fraud and mail fraud), and try to pursue Patrick in small claims court. I've avoided that path so far because I didn't have time to pursue it, and I don't think this is worth someone getting a criminal record over, but he's leaving me no choice.

OCT 20, 2001 UPDATE
:
The first cheque has BOUNCED. Yes, that's right, after I thought it cleared ok I received a letter from the Royal Bank of Canada telling me there was insufficient funds on the account. I received this letter the same day that I cashed cheque number two, so I have my doubts as to whether or not the second one will cash. Patrick's phone number was on the cheque, and up until this point I've avoided calling him. After I read the cheque had bounced, I immediately got on the phone and called him. He sounded surprised and scared to hear from me, and he assured me that the second cheque would not bounce and that the first one bounced because his bank account was "frozen". He claims he'll send me a money order for the first cheque that bounced, but we'll see. I can't believe this guy - he continues to lie and cheat!

OCT 14, 2001 UPDATE

The first cheque has been cashed, and it appears to have cleared. I'll know for sure on Monday. I'm very pleased to have gotten 50% of my money back, and I'm hoping the other cheque will clear without incident. Almost done with this process!

OCT 2, 2001 UPDATE
:
Patrick has sent me two post-dated cheques, each for $670. The first is dated for October 4th, the second for October 18th. I'm leery to trust Patrick with his track record, but I'll assume that these are legitimate and will cease my legal actions against him. Please do not email Patrick privately any longer - check back here on October 4th and 18th to see how this all ends up...

Here's a chronology of events:

  1. July 22, 2001 - I win the Bargain and Haggle.com bid for an Olympus E-10 Camera
  2. July 23, 2001 - Patrick tells me he will ship the camera as soon as I give him a tracking number for the money order
  3. July 24, 2001 - I ship him the money order and the tracking number
  4. July 27, 2001 - Patrick gives me a false tracking number for the camera shipment
  5. July 31, 2001 - Patrick admits his girlfriend received my payment, and I'll have my camera tomorrow
  6. August 1st, 2001 - Patrick admits the camera was never shipped at all
  7. August 5th, 2001- Patrick offers me a refund
  8. August 15th, 2001 - Still no refund from Patrick, he faxes me a shipping invoice indicating he's sent my money, but the address is incorrect on it, so it never arrives
  9. September 4th, 2001 - Still no refund from Patrick
  10. September 18th, 2001 - Patrick claims he sent my refund on the 14th
  11. September 22nd, 2001 - Still no refund from Patrick
  12. September 23rd, 2001 - Patrick emails me and says he can do is pay me in two instalments, proving that all previous emails saying he sent me a refund were lies. I don't believe this offer to pay me is any more realistic than his previous lies.
  13. I receive two post-dated cheques, each for $670 Canadian. The first is post-dated for Oct. 4th, the second for Oct. 18th.
  14. I cash the first cheque on the 4th, I assume it clears ok, and I cash the second cheque on the 18th. On the 18th I receive a letter from the bank telling me the first cheque has bounced (see top of the page for scans).
  15. The second cheque has also bounced, and Patrick is still saying he's going to pay me. Not likely...
  16. November 21st, 2001 - Patrick mails me a money order for $500 CND, so I've now recovered some of my money.
  17. December 28th, 2001 - No further money or communication from Patrick. I'm still out $840 CND.

I've waited nearly SIX months for Patrick to make good on his promises and refund my money, but he hasn't done so. I'm therefore creating this web site to expose his acts and hope that:

  1. No one else falls prey to his scams
  2. He is pressured into refunding my money. I can't afford to simply forget about $1340!

I was searching Bargain and Haggle in early August 2001, and guess what I found? Another E-10 up for bid by none other than Patrick Clouet (who goes by "Real Life" as his handle). I signed up under a new account name and began asking him questions about the camera, it's serial number, etc. Three days later he pulled the camera listing.

Patrick, I'd like to believe you - I would. I'm generally a trusting person (which is why I sent you the money order, no questions asked), but when I enter the number in, I get the following info:

If your item was sent recently, that status may not have been input yet. Please allow one business day and try again. 

I've tried it with and without the PK, and I've called Canada Post and they tell me that number isn't valid. Did the fax smudge the number? Is that the correct number - can you verify?

And if the money was sent, where on earth is it? That was five business days ago - it should have been here by now.

Not that I'm surprised, but the Xpresspost package hasn't arrived, and surprise surprise, the tracking number on the fax you sent me isn't a valid one (this appears to be your MO). 

What I'm curious about is how you got it stamped at the post office and made it look official? I noticed you got the address wrong too - you left off the #104. It should have still arrived here however.
